Skyllamas Podcast Studio Package Purchase Terms and Conditions
Thank you for choosing a package from Skyllamas Podcast Studio. By purchasing our package, you agree to the following terms and conditions:
1. Scope of Services & Scheduling
Service Outline:
Provides podcast production services according to the purchased package.
Includes a one-hour recording slot, 15-minute buffers before and after the session, and additional amenities (e.g., a green room).
Scheduling Requirements:
Sessions must be purchased and scheduled in advance.
Rescheduling Policy:
Advance Notice:
Free rescheduling if informed more than 48 hours in advance.
Short Notice/Fees:
A $50 fee applies for rescheduling with 24–48 hours notice.
Same-day changes are treated as cancellations.
New Clients:
Receive one free reschedule regardless of the notice period.
2. Cancellation Policy
Refund Tiers:
Full refund (minus a 10% processing fee) for cancellations made more than 48 hours before the session.
Partial refund or full credit for cancellations between 24 and 48 hours before the session.
No refund for cancellations within 24 hours or no-shows.
Non-Refundable Booking Fee:
A 20% non-refundable booking fee is required at the time of booking.
3. Force Majeure and Technology Failures
Force Majeure:
Covers events such as severe weather, natural disasters, etc.
Allows for fee-free rescheduling, subject to mutual agreement and verification.
Technology & Equipment Failures:
The studio provides backup equipment.
Immediate problem resolution measures are outlined.
4. Financial Terms
Emergency Exceptions:
The studio may grant exceptions in emergencies on a case-by-case basis.
Refund Window for Unused Sessions:
Sessions can be refunded within 30 days if not used.
Sessions expire after one year.
Damage Accountability:
Clients are responsible for any damages caused by negligence or misconduct (e.g., excessive alcohol consumption).
5. Content Management & Intellectual Property
Intellectual Property Rights:
Clients retain rights to the finalized, edited podcasts.
The studio retains ownership of the raw recording materials.
Storage & Backup:
The studio will hold raw materials for a minimum of one year.
Clients are advised to maintain their own backups.
Third-Party Materials:
Clients must secure necessary rights for any third-party content used.
Content Compliance:
All content must conform to legal standards and the studio’s policies.
The studio may withhold content release if it violates these rules.
6. Studio and Client Responsibilities
Behavior & Conduct:
Guidelines cover punctuality, consumption of alcohol, smoking, and guest behavior.
A professional and respectful environment is mandated.
Termination Rights:
The studio reserves the right to terminate sessions for disruptive or dangerous behavior.
Clients remain financially liable even if a session is terminated due to misconduct.
7. Promotional Use and Rights
Permission for Promotion:
The studio may use portions of produced content for promotional purposes.
Clients have the option to opt out.
Compensation:
No compensation is provided to clients for promotional use of their content.
8. Legal and Compliance
Confidentiality and Liability:
Provisions ensure the confidentiality of client information.
The studio’s liability regarding client-produced content is limited.
Indemnification:
Clients agree to indemnify the studio in the event of legal repercussions stemming from their content.
9. Operational Policies and Policies for Minors
Session Duration & Delivery Timeline:
Clients can expect delivery of the final podcast content within one to three weeks post-session.
Minor Participation:
Minors may use the services if they have parental consent and adult accompaniment.
Appropriate documentation for parental consent is required.
Data Privacy & Safety:
Additional precautions are taken to protect minors’ privacy.
10. Recording Approval and Release for Participants
Mandatory Consent:
All participants must sign a recording release form.
Usage of Recorded Content:
Clearly outlines the purposes for which the recordings may be used.
Helps avoid disputes over unauthorized content usage.
11. CCTV Surveillance Policy
Security Measures:
CCTV is used in common areas only, with clear signage indicating surveillance.
Compliance with Local Law:
